Terms of Service
Current at 2025. Subject to change at any time. Please contact us with any queries.
Fees
Our pricing are quoted on an hourly or per-project basis. All projects vary in their technical and design requirements and complexity, and there are many factors that will affect the time and input needed to complete a project. We’ll work with you to define a clear and accurate brief, which we’ll use to provide an accurate proposal suited specifically to your project needs and scope.
Consultation
We prefer to meet with our clients face-to-face to learn about your venture or project, and what it is you are specifically wanting to do. We'd love to grab a coffee or tea somewhere convenient for you, or at your office or workspace. There is no charge for our initial meeting, but any consultations which are not of a ‘meet and greet’ nature and involve work outcomes are charged on an hourly basis.
Location
We're based in Byron Bay and are available to meet for a complimentary consultation anywhere in the Northern Rivers NSW area. Locations outside of this area are also completely achievable, so please touch base with us to discuss your project needs and location. We can easily jump on a call or video call in we’re unable to meet in person.
Timeframe
We'll always do our best to meet your timeframe requirements for a project - we know how important it is to see your new website or design launched! We use the Project Proposal document supplied to you, as well as any verbal or written agreements, as the framework for the project. All timeframes communicated in any of these forms are estimations and may vary, dependant on many factors. We reserve all rights to extend the project timeframe for any reason.
Copyright
Once work is under way, and during the entire process until the work is completed, all work is subject to copyright, and is strictly property of Future Good and cannot be used in any way. Once the project is completed and full payment is made, all finished work and unrestricted ownership of copyright is transferred to the client. Future Good may freely use any client work for promotional use.
Agreement Formalisation
As per Contract Law in Australia, the Project Proposal supplied at the start of our engagement, and any subsequent agreements made in writing, form a binding contract for our project. The Project Proposal document will be provided prior to commencing a project, and outlines the project scope, all inclusions and fees, and non-binding references for the intended outcome of your project.
Once an agreement is formed in writing, typically by email, and/or when the first payment is made as per the Fee Schedule outlined in the Project Proposal, this acts as a formal contractual agreement between 'Kyle Haustorfer T/A Future Good' and you, the client, for the full duration of the project. All tasks, commitments and fees required of both parties, are to be completed as per this contractual agreement. Verbal agreements may not be honoured and should always be confirmed in writing.
Future Good may use the name ‘Kyle Haustorfer’ or ‘Ky Haus’ interchangeably when forming this agreement.
Project Completion / Asset Ownership
Once all items and tasks outlined in the Project Proposal are complete, and full payment is made by you, all completed items and assets will be handed freely to you, and unrestricted ownership of these items, including the copyright of which, is given. For website projects, this means you'll be transferred the 'owner' permission for the website, which allows you to do as you wish with the website and related assets from then onwards.
Prior to the completion of the project, and the payment of the final invoice, ownership and copyright of all assets related to the project are held by Future Good. Assets include, but are not limited to, working design files, construction and layout of website pages, HTML and CSS code, document templates or Canva files. Future Good is not obliged to keep a copy of your project files after 30 days from the completion of the project, so please keep a copy of the files on your own accounts and/or storage.
Image / Asset Usage
Kyle Haustorfer ( Ky Haus), Future Good, all subsequent businesses, all correlated businesses, and all project collaborators reserve the right to freely use any designs, images, screenshots, videos, content or publications of any kind related to the project for their own prospecting, advertising or promotion, unless formally agreed upon otherwise in writing - at the time of engagement or prior to the completion of the project.
Project Cancellation
Circumstances can change, we totally get it! You have every right to cancel the project after commencement - however, please understand that the project is governed by Contractual Law in Australia and fees and commitments will reflect these laws.
Fees are typically invoiced in correlation with the project milestones outlined in the Project Proposal, and actual work completed to date. After each milestone is achieved in the project outline, any fees paid prior to requesting cancellation will be forfeited, and additional fees will be payable depending on the amount of work completed. Fees payable may be up to 100% of the total project fees. As a result of cancelling an uncompleted project, we cannot guarantee providing a usable product that doesn’t require additional development in order to make it usable.
Additionally, there may be some limitations for using and publishing any of the products or services provided as part of the project, due to copyright limitations of our contract, and avoidance of unfavourable representation of our work. We adhere to Fair Work Australia and governing rules of Contractual Law in Australia when making decisions surrounding fees and cancellations.
